1. About DreaMaker

DreaMaker Creative Station is a creative animation and visual production studio based in Dhaka, Bangladesh. We provide services including 2D/3D animation, motion graphics, VFX, commercial video production, event design, and product visualisation for businesses and agencies.

2. Services and Quotations

All project engagements begin with a written quotation or project agreement shared by DreaMaker. Services are considered confirmed only after:

• The client provides written approval (email or message) of the quotation.
• An advance payment has been received as specified in the project agreement.

DreaMaker reserves the right to decline any project at its discretion without obligation to provide a reason.

3. Payment Terms

• Advance Payment: A minimum of 50% advance payment is required before production commences, unless otherwise agreed in writing.
• Final Payment: The remaining balance is due before final file delivery.
• Revisions: The number of included revision rounds will be stated in the project quotation. Additional revisions beyond the agreed scope will incur extra charges.
• Overdue Payments: DreaMaker reserves the right to pause project work for invoices outstanding beyond 7 days of the due date.

4. Project Timeline

Estimated timelines are provided at the start of each project. Timelines are subject to:

• Timely receipt of client-supplied assets, content, and approvals.
• The agreed number of revision rounds.
• Factors outside DreaMaker’s reasonable control (force majeure, technical outages).

Delays caused by the client’s late feedback or content provision may extend the project timeline without obligation on DreaMaker’s part.

5. Client Responsibilities

The client agrees to:

• Provide accurate briefs, references, and required assets in a timely manner.
• Ensure they hold all necessary rights to any materials, logos, brand assets, or third-party content supplied to DreaMaker.
• Review and provide feedback within the agreed timeframes.
• Make payments as per the agreed schedule.

6. Intellectual Property and Ownership

• Before Full Payment: All creative work, source files, and deliverables remain the intellectual property of DreaMaker Creative Station until full payment has been received.
• After Full Payment: Upon receipt of final payment, DreaMaker transfers ownership of the agreed final deliverables to the client for the purposes specified in the project brief.
• Portfolio Rights: DreaMaker retains the right to display completed work in its portfolio, website, social media, and promotional materials, unless the client requests confidentiality in writing prior to project commencement.
• Source Files: Source files (e.g., project files, raw renders, editable formats) are provided only if explicitly included in the agreed quotation scope.

7. Revisions and Change Requests

Minor revisions within the original project scope are included as stated in the quotation. Change requests that alter the direction, scope, or duration of the project will be assessed and quoted separately. DreaMaker will notify the client in writing before proceeding with out-of-scope work.

8. Cancellation Policy

• If the client cancels a project after work has commenced, the advance payment is non-refundable.
• Any work completed up to the point of cancellation will be invoiced proportionally.
• If DreaMaker cancels a project for reasons within its control, any unused portion of advance payment will be refunded.

9. Confidentiality

Both parties agree to keep confidential any sensitive business information, pricing, and proprietary details shared during the course of a project. This obligation continues for a period of 2 years following project completion.

10. Limitation of Liability

DreaMaker’s total liability in connection with any project shall not exceed the total fees paid by the client for that specific project. DreaMaker is not liable for indirect, incidental, or consequential damages arising from the use of our deliverables.

DreaMaker is not responsible for third-party platforms, tools, or services used to host or distribute the final deliverables.

11. Warranties

DreaMaker warrants that all creative work produced is original and does not knowingly infringe third-party intellectual property rights. The client warrants that all materials supplied to DreaMaker are owned or properly licensed by the client.

12. Governing Law

These Terms of Service are governed by the laws of the People’s Republic of Bangladesh. Any disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of courts in Dhaka, Bangladesh.

13. Changes to These Terms

DreaMaker reserves the right to update these Terms of Service at any time. Updated terms will be posted on this page. Continued engagement with our services after changes constitutes acceptance of the revised terms.
